What Is a Contingency Fee in a Personal Injury Case?
Learn how contingency fees work in personal injury cases, including when attorney’s fees are paid and why most accident lawyers do not charge upfront fees.

Most personal injury lawyers work on what is called a contingency fee basis. This means the attorney’s fee is contingent upon making a recovery in the case.
In other words, the attorney typically does not get paid unless there is a settlement or verdict.
Instead of charging hourly legal fees upfront, the attorney receives an agreed-upon percentage of the recovery at the end of the case. This allows injured accident victims to pursue legal representation without paying large retainers or hourly bills while the case is ongoing.
In many personal injury cases, the law firm may also advance litigation costs and case expenses during the claim. These can include:
medical record charges,
filing fees,
expert fees,
deposition costs,
and investigation expenses.
If there is no recovery, the client is generally not responsible for attorney’s fees under a contingency fee agreement.
Contingency fees are common in:
car accident cases,
truck accident claims,
motorcycle accident cases,
slip and fall injuries,
and wrongful death claims.
Because the attorney’s fee depends on the outcome of the case, contingency fee arrangements also align the attorney’s interests with the client’s recovery.
